General Terms and Conditions \u2013 GTC<\/h1><\/div>

of Soft Car Wash DE GmbH, L\u00f6rrach<\/p>\n<\/div>

\n<\/b>Soft Car Wash provides all cleaning and maintenance services in connection with the use of our car wash facilities exclusively on the basis of these GTC and the operating instructions at the entrance of the car wash. Vacuum cleaners for vehicle interior cleaning are not subject to these GTC. Their use is at the sole responsibility of our customers.<\/p>\n

\n<\/b>Soft Car Wash guarantees proper, gentle, and safe cleaning of vehicles, in accordance with the state of general car wash technology at the time of use. The decisive factor for proper cleaning is, on one hand, the degree of dirt and the selected wash program, and on the other hand, the performance that can usually be expected from a fully automatic car wash based on the state of general car wash technology.<\/p>\n

\n<\/b>The user must assert any claims for the remedy of insufficient cleaning immediately after leaving the facility. Soft Car Wash reserves the right to perform such remedial work in this case.<\/p>\n

\n<\/b>The user of the car wash is obliged to draw the staff\u2019s attention in good time to circumstances that suggest a risk of damage to the vehicle or the car wash facility. This applies in particular to improperly attached vehicle parts (e.g., trim, mirrors, antennas, spoilers, fog lights, turn signals, headlight cleaning systems), parts that are not part of the standard equipment, or in the case of material fatigue, wear, weathering, etc., as well as pre-damaged vehicle parts or older vehicles. If the user fails to provide such notice, Soft Car Wash\u2019s liability for any kind of damage is excluded, unless such liability arises from fault.<\/p>\n

5.
\n<\/b>Soft Car Wash points out that the following measures and rules of conduct must be carried out or observed when entering the car wash:<\/p>\n

  • Retract or remove the antenna<\/li>\n
  • Fold in exterior mirrors<\/li>\n
  • Remove roof racks, ski racks, taxi signs, and other attachments<\/li>\n
  • Close and lock the fuel cap<\/li>\n
  • Switch off windshield wipers and deactivate rain sensors<\/li>\n
  • Protect the rear windshield wiper with a plastic cover<\/li>\n
  • Set the transmission selector to \u201cN\u201d or put in neutral<\/li>\n
  • Release the handbrake or parking brake<\/li>\n
  • Do not turn off the engine<\/li>\n
  • Do not brake, steer, or exit the vehicle during the wash process!<\/li>\n
  • Honk continuously in case of danger<\/li>\n
  • Drive away promptly at \u201cgreen\u201d when exiting<\/li>\n<\/ul>\n

    6.
    \n<\/b>Soft Car Wash is liable to the user for compensation for any damage, provided that this is based on circumstances that could have been averted by applying the necessary care. Conversely, liability for damages caused by the failure to observe clearly displayed, unambiguous entry and usage instructions is excluded, unless Soft Car Wash is liable due to fault.<\/p>\n

    \n<\/b>In the event of damage caused by the washing process in the car wash and through the fault of Soft Car Wash, the latter shall be liable for the direct damage. Consequential damages will be compensated provided they are foreseeable and typical and Soft Car Wash is liable due to fault.<\/p>\n

    \n<\/b>Liability for damage to parts attached to the exterior of the body, e.g., trim, mirrors, antennas, spoilers, auxiliary lights, etc., as well as for paint and scratch damage caused thereby, remains excluded, unless Soft Car Wash has culpably failed to exercise the required standard of care.<\/p>\n

    9.
    \n<\/b>Soft Car Wash excludes liability for damage to the following vehicle parts: tires and rims with a width of more than 32 cm, tires and rims with a height of less than 5.5 cm, vehicles with a ground clearance of less than 9 cm, vehicles with a total height over 2.15 m, vehicles with a total width over 2.25 m, rims with protruding edges, vehicles with track wideners on the rear axle, vehicles with non-factory-fitted\/retrofitted parts, and damage triggered by vehicle sensors. Damage to anodized parts is also excluded from liability.<\/p>\n

    \n<\/b>Claims for compensation for obvious damage can only be asserted if the damage has been reported to the responsible facility manager before leaving the premises.<\/p>\n
